Welcome to Glass Bead Magnetics™! The terms “we,” “us,” and “our” refer to Glass Bead Magnetics™. Glass Bead Magnetics™ operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience—the “Services.”

The below terms and conditions, together with any policies referenced herein—these “Terms of Service” or “Terms”—describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

Section 1 — Access and Account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address and billing, payment, and shipping information.

You represent and warrant that all information you provide through our store is correct, current, and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 — Our Products

We have made every effort to provide an accurate representation of our products and Services in our online store. However, please note that colors, textures, finishes, dimensions, or overall product appearance may differ from how they appear on your screen due to lighting, photography, the device you use to access the store, and your device settings and configuration.

Glass Bead Magnetics™ products are individually 3D printed and prepared in small batches. Visible layer lines, seams, minor texture differences, slight color variations, and small surface imperfections are normal characteristics of the 3D-printing process. These cosmetic characteristics are not considered defects when they do not affect the product’s intended function.

We do not warrant that the appearance or quality of any products or Services purchased by you will meet every personal expectation or appear exactly as depicted or rendered in our online store.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region, or jurisdiction on a case-by-case basis.

Section 3 — Orders

When you place an order, you are making an offer to purchase. Glass Bead Magnetics™ reserves the right to accept or decline your order for any reason at its discretion.

Your order is not accepted until Glass Bead Magnetics™ confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting it, as Glass Bead Magnetics™ may be unable to accommodate cancellation or modification requests after an order has been accepted or entered production.

If we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email address, billing address, and/or telephone number provided at the time the order was placed.

Your purchases are subject to return, replacement, or refund solely in accordance with our Return Policy.

Glass Bead Magnetics™ tools may be used for personal nail art or as part of legitimate professional nail services. However, you represent and warrant that your purchase is not being made for unauthorized commercial resale, export, reproduction, manufacturing, or distribution.

Section 4 — Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be listed in your order-confirmation email.

Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs charges, duties, or import fees.

Prices posted in our online store may differ from prices offered through physical locations, special events, social-media sales, wholesale arrangements, or other stores operated by third parties.

We may offer promotions that affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms of a promotion and these Terms, the promotion terms will govern.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made through our store. You agree to promptly update your account and other information, including your email address and payment information, so that we can complete your transactions and contact you as needed.

You represent and warrant that:

The payment information you provide is true, correct, and complete;
You are duly authorized to use the payment method provided;
Charges incurred by you will be honored by your payment provider; and
You will pay all charges incurred at the posted prices, including shipping, handling, and applicable taxes.

Section 5 — Shipping and Delivery

Glass Bead Magnetics™ products are individually prepared in small batches. Please allow approximately one to two weeks for order processing before shipment unless a different processing timeframe is stated on the applicable product page.

Processing time and shipping time are separate.

All delivery dates and shipping times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, weather, incorrect or incomplete addresses, or events outside our reasonable control.

If we are unable to ship your order within the stated or otherwise applicable timeframe, we will contact you regarding the delay and provide any options required under applicable law.

Once we transfer products to the shipping carrier, risk of loss may pass to you to the extent permitted by applicable law.

You are responsible for reviewing and entering a complete and accurate shipping address before submitting your order. Glass Bead Magnetics™ is not responsible for packages delivered to an address incorrectly entered by the customer.

Section 6 — Returns and Damaged Items

We hope you love your Glass Bead Magnetics™ product. Because each tool is individually 3D printed and prepared in small batches, we do not accept returns or exchanges for change of mind, personal preference, ordering the wrong product, or normal characteristics of the 3D-printing process.

The exception is when a product arrives damaged, is not functioning as intended upon delivery, or is different from the item ordered.

Please inspect and test your product promptly after delivery. To report an eligible issue, contact us and provide your name, order number, a description of the issue, clear photographs of the product and packaging, and a short video demonstrating the issue when applicable.

Battery-operated products must be tested with four new, correctly installed AAA batteries before being reported as defective. Batteries are not included.

Once the issue has been reviewed and confirmed, we may offer an appropriate resolution, including repair, replacement, or refund. Please do not return or discard the product unless instructed to do so.

Damage caused after delivery by misuse, dropping, modification, improper storage, liquids, acetone, chemicals, excessive heat, incorrect battery installation, or normal wear is not considered arrival damage.

Nothing in this policy limits rights or remedies that cannot legally be excluded under applicable consumer-protection laws.

Section 7 — Product Use and Safety

Glass Bead Magnetics™ products, including La Magia™, are motorized magnetic nail-art tools intended for adult use with magnetic nail polish.

Our products are not toys, medical devices, nail-curing lamps, or substitutes for following the instructions and safety requirements provided by the manufacturer of your magnetic nail polish.

By purchasing or using a Glass Bead Magnetics™ product, you agree to use it only as intended and to follow all product instructions and warnings.

Place the tool on a stable, level surface before use. Keep hair, jewelry, clothing, fingers, and other objects away from moving components. Do not touch, stop, reposition, or adjust the rotating magnetic disc while the product is operating.

Turn the product off before changing batteries, cleaning it, moving components, or making adjustments.

Do not immerse the product in water or expose it to spills, acetone, nail-polish remover, oils, chemicals, extreme heat, or open flames.

Do not disassemble, rewire, modify, or attempt to repair the product. Stop using the product immediately if the rotating disc, magnets, wiring, battery compartment, or any structural component becomes loose, cracked, exposed, or damaged.

Failure to follow the provided instructions and warnings may result in product damage or personal injury.

Section 8 — Batteries and Magnets

La Magia™ requires four AAA batteries, which are not included.

Batteries must be installed according to the positive and negative polarity markings. Do not mix old and new batteries or different battery types or brands. Do not attempt to recharge batteries that are not specifically designed to be rechargeable.

Remove batteries before extended storage. Stop using the product if the batteries leak, corrode, swell, overheat, or appear damaged.

Glass Bead Magnetics™ products contain strong magnets. Keep the product and all magnetic components away from children and pets. Magnets should never be placed in the mouth or swallowed.

If a magnet or magnetic component becomes detached, stop using the product immediately and secure the loose component where it cannot be accessed by children or animals.

Strong magnets may interfere with pacemakers, implanted medical devices, magnetic cards, watches, electronics, and data-storage devices. Individuals with implanted medical devices should consult the device manufacturer or an appropriate healthcare professional before using or handling products containing strong magnets.

Section 9 — Magnetic Nail-Art Results

Glass Bead Magnetics™ tools are designed to assist users in creating glass-bead effects with magnetic nail polish. However, magnetic-polish formulas differ in magnetic-particle concentration, viscosity, coat thickness, application requirements, curing time, and overall responsiveness.

We do not guarantee that every polish, nail shape, placement, distance, or technique will produce an identical glass-bead effect.

Results may vary based on the magnetic polish used, application technique, nail position, distance from the magnets, coat thickness, curing timing, battery strength, and other factors outside our control.

You are responsible for following the application, curing, and safety instructions provided by the manufacturer of the magnetic nail polish being used.

Section 10 — Intellectual Property

Original Designs — Do Not Copy or Reproduce

All Glass Bead Magnetics™ products are original designs created and developed by Glass Bead Magnetics™.

Purchasing a Glass Bead Magnetics™ product grants the purchaser the right to use the finished nail-art tool for personal nail art or legitimate professional nail services.

Purchasing a product does not grant permission or a license to copy, scan, mold, cast, reverse engineer, recreate, reproduce, manufacture, distribute, sell, or share replicas, components, or digital design files for personal or commercial purposes.

Our Services, including but not limited to all trademarks, brands, text, product descriptions, displays, images, graphics, photographs, product reviews, videos, audio, CAD files, 3D-printing files, packaging, logos, and the design, selection, and arrangement thereof, are owned by Glass Bead Magnetics™, its affiliates, or licensors and are protected by applicable intellectual-property laws.

These Terms permit you to use the Services for your personal, noncommercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, scrape, or transmit any material from the Services without our prior written consent.

Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, trade-dress right, or other intellectual property belonging to Glass Bead Magnetics™ or any third party.

Unauthorized use may violate federal or state intellectual-property laws. Unauthorized copying or use may result in removal requests, platform reports, cease-and-desist demands, and enforcement of available legal rights and remedies.

Glass Bead Magnetics™, La Magia™, our logos, product names, designs, and slogans are trademarks of Glass Bead Magnetics™. You must not use these trademarks without our prior written permission.

All rights not expressly granted herein are reserved by Glass Bead Magnetics™.

Section 11 — Optional Tools

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have control over.

You acknowledge and agree that we provide access to such tools “as is” and “as available,” without warranties, representations, or conditions of any kind and without endorsement.

We shall have no liability arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the website is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms under which the relevant third-party provider offers those tools.

We may also offer new features or resources through the Services in the future. Such new features and resources will be considered part of the Services and will be subject to these Terms.

The Services may contain materials and hyperlinks to websites provided or operated by third parties, including embedded third-party functionality.

We are not responsible for examining or evaluating the content, accuracy, policies, or practices of third-party materials or websites you choose to access.

If you leave our Services to access third-party materials or websites, you do so at your own risk.

We are not liable for harm or damages related to your access to third-party websites or your purchase or use of third-party products, services, resources, or content.

Please carefully review the third party’s policies and practices before engaging in a transaction. Questions, complaints, claims, or concerns regarding third-party products and services should be directed to the applicable third party.

Section 13 — Relationship With Shopify

Glass Bead Magnetics™ is powered by Shopify, which enables us to provide the Services. However, any sales and purchases made through our store are made directly with Glass Bead Magnetics™.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Glass Bead Magnetics™, including any injury, damage, or loss resulting from products or services purchased through our store.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to transactions between you and Glass Bead Magnetics™.

We reserve the right to correct errors, inaccuracies, or omissions and to change or update information or cancel orders if information is inaccurate at any time without prior notice, including after you have submitted an order.

If we cancel an order after payment has been processed, we will issue the appropriate refund.

You may access and use the Services only for lawful purposes.

We do not guarantee that every magnetic nail polish, application method, nail position, magnet distance, or curing technique will produce the same or any particular glass-bead effect.

Some jurisdictions limit or do not permit the disclaimer of certain implied warranties. In those jurisdictions, portions of this disclaimer may not apply to you.

Nothing in these Terms limits rights or warranties that cannot legally be excluded.

Section 20 — Limitation of Liability

To the fullest extent permitted by law, Glass Bead Magnetics™, our owners, partners, employees, affiliates, agents, contractors, service providers, or licensors, and Shopify and its affiliates, will not be liable for any injury, loss, claim, or direct, indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or products purchased through the Services.

This includes damages arising from improper use, failure to follow product instructions, exposure to liquids or chemicals, battery misuse, unauthorized repairs or modifications, detached magnets, use near magnetic-sensitive objects or implanted medical devices, or contact with moving components.

This limitation also includes lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages.

Some jurisdictions do not permit the exclusion or limitation of certain damages. In those jurisdictions, our liability will be limited to the greatest extent permitted by law.

Section 21 — Indemnification

You agree, to the extent permitted by applicable law, to indemnify, defend, and hold harmless Glass Bead Magnetics™, Shopify, and our respective affiliates, owners, partners, employees, agents, contractors, licensors, and service providers from losses, damages, liabilities, or third-party claims, including reasonable attorneys’ fees, arising out of:

Your breach of these Terms or policies incorporated by reference;
Your violation of applicable law or the rights of a third party;

Your misuse, alteration, or unauthorized repair of a product; or
Your unauthorized copying, reproduction, manufacture, or distribution of a Glass Bead Magnetics™ product or design.

We will notify you of an indemnifiable claim. Failure to provide prompt notice will not relieve you of your obligations unless you are materially prejudiced.

We may control the defense and settlement of the claim at your expense, including the selection of counsel, but will not agree to a settlement requiring nonmonetary obligations from you without your consent, which shall not be unreasonably withheld.

You agree to cooperate in the defense of an indemnifiable claim, including by providing relevant documents and information.
